Introduction

Welcome to YouCarGO, a digital platform designed to facilitate vehicle rentals between private individuals in a secure and transparent manner. By using our services, whether as a vehicle owner (“Owner”) or as a renter (“User”), you agree to comply with and be bound by these Terms and Conditions. Please read them carefully before proceeding with registration and use of the platform.

  1. General Terms for All Users

By registering on YouCarGO, all users agree to provide accurate, complete, and truthful information. Any attempt to register with false documents, misleading photos, or inconsistent details may result in the immediate termination of the account and a financial penalty of up to CHF 2,000, automatically charged to the violating user without the possibility of appeal. Users will be notified and given 7 days to submit supporting evidence to contest the charge. If no valid counter-evidence is provided, the penalty will be considered final. YouCarGO reserves the right to conduct verifications and request additional documentation at any time.

YouCarGO acts solely as a facilitator of rental transactions and does not own, operate, or manage any of the vehicles listed on the platform. All rental agreements are directly between the Owners and Users.

  1. Commission Structure and Payment Process

YouCarGO operates with a dynamic commission structure that may vary based on market conditions, competition, and operational costs. Our goal is to maintain competitive and fair pricing for all users. Any changes in commission rates will be clearly displayed before confirming a rental or listing a vehicle, and users will be notified at least 14 days in advance before the new rates take effect.

Payment Process

  • When a renter books a vehicle, they complete the payment directly through the YouCarGO platform.
  • YouCarGO temporarily holds the full rental amount in escrow for security purposes until the rental period concludes.
  • Once the rental is successfully completed and no disputes are raised, YouCarGO deducts (for the Platform and Service maintenance):
    • A commission from the renter as a service fee.
    • A commission from the owner before transferring their earnings.
  • The remaining balance is then transferred to the vehicle owner within 14 days after the end of the rental period, provided no disputes or claims have been raised. If no disputes or issues are reported, YouCarGO may process the payout sooner at its sole discretion.
  1. Terms for Vehicle Owners

31 Listing Requirements

Owners must ensure that the information provided about their vehicle is accurate, including but not limited to make, model, year, mileage, insurance status, and any additional conditions. Vehicle photos must be recent and accurately represent the current condition of the vehicle.

3.2 Legal and Insurance Obligations

Owners are solely responsible for ensuring that their vehicle complies with all legal requirements, including roadworthiness, insurance, and registration. YouCarGO does not provide or facilitate insurance policies; all coverage must be arranged by the Owner.

3.3 Responsibilities in Case of Disputes

Should any disputes arise regarding damages, theft, or other issues, the Owner acknowledges that YouCarGO is not responsible for mediation or compensation. However, the platform may, at its discretion, facilitate communication between parties to find a resolution.

3.4 Cancellation Policy

Owners can cancel a confirmed booking free of charge if done at least 48 hours before the scheduled rental period. Cancellations within 48 hours will incur a penalty of 50% of the total rental fee, payable to the User as compensation for the inconvenience.

  1. Terms for Renters (Users)

4.1 Use of Rented Vehicles

Users must use the rented vehicle responsibly and in accordance with local laws and regulations. Vehicles must be returned in the same condition in which they were received, considering normal wear and tear.

4.2 Liability and Damages

The renter is solely responsible for any fines, penalties, or damages incurred during the rental period. YouCarGO is not liable for any financial losses or legal claims arising from the misuse of a rented vehicle. However, YouCarGO may assist in providing transaction details to facilitate dispute resolution between users.

4.3 Cancellation Policy

Users can cancel a booking free of charge if done at least 48 hours before the rental period. Cancellations made within 48 hours of the start date will incur a penalty of 50% of the total rental fee, which will be transferred to the Owner as compensation.

  1. Prohibited Conduct

Both Owners and Users are prohibited from engaging in fraudulent activities, misrepresenting vehicle conditions, or attempting to bypass YouCarGO’s payment system. Any such violations may result in account suspension, legal action, and financial penalties.

  1. Limitation of Liability

YouCarGO provides a digital marketplace and assumes no liability for any damages, disputes, or losses arising from transactions facilitated through the platform. Users acknowledge and accept that all transactions are conducted at their own risk. YouCarGO does not own, inspect, or guarantee the condition of any listed vehicle. All transactions occur directly between the Owner and the Renter, and YouCarGO is not responsible for mechanical failures, damages, or legal violations associated with a rental.

  1. Amendments to Terms and Conditions

YouCarGO reserves the right to modify these terms at any time. Users will be notified of significant changes, and continued use of the platform constitutes acceptance of the updated terms.

  1. Governing Law

These Terms and Conditions are governed by the laws of Switzerland. Any disputes arising from these terms shall be settled in the competent courts of Switzerland.

By registering and using the YouCarGO platform, all users expressly agree to these Terms and Conditions, including the platform’s payment structure and commission system.
